1.    Using the Avenir App

This policy (“Privacy Policy”) sets out how Avenir collects your Personal Information and uses it after you enter the information on the Avenir App.  Unless otherwise indicated, the Privacy Policy only applies to the data that you input into the Avenir App.  By using the Avenir App, you agree to be bound by this Privacy Policy, which may be amended from time to time in future.  Undefined, capitalized terms in this Privacy Policy have the same meaning as in the Avenir Terms and Conditions (“Avenir T&C’s”). 

We in Avenir are committed to ensure that your privacy is secured and protected. We respect your right to know how we collect, use, view and protect your information that we require of you when you set up your Avenir Account and register on the Avenir App (“Personal Information”). That’s why we are giving this notice to inform you on how we process your Personal Information.

We may update this policy as necessary to keep it responsive with data privacy requirements, coverage and technology security advancement to give the best information security on your Personal Information. You are encouraged to check this page from time to time to ensure that you are updated and pleased with any changes we made.

 

2.    Our reason why we collect your Personal Information

We collect your Personal Information, without limiting the generality of the purpose, to facilitate your transaction needs and avail of our services, among others:

  • Enhance your customer experience and improve, develop and determine how to meet your preferences and needs while purchasing Cryptocurrencies;
  • Communicate relevant updates, products and/or advisories to you;
  • Show you relevant information relating to our services and measure the effectiveness;
  • Abide by any safety, security, public service or legal requirements and processes; and
  • Process information for statistical, analytical, and research purposes

We collect your Personal Information only to the extent necessary to comply with the requirements of Applicable Law as stipulated in the Avenir T&C’s and as a legal and regulatory obligation. 

We also need your Personal Information for statistical, analytical, and research purposes to create anonymous and aggregate reports.

When required by our Privacy Policy and the law and before we use or process your Personal Information for any other purpose, we will ask for your consent.

 

3.    We collect the following information

We collect the following Personal Information from you, namely your:

  • full legal name;
  • email ID;
  • date of birth,
  • mobile phone number,
  • your residential address; and
  • any other details as Avenir may require while registering you.

Further, Avenir will be able to view your social security number, your location and your transaction history.  

 

4.    Our way to collect your Personal Information

We only collect your Personal Information through the Avenir App when you enter in the information that we require for you to register with us.  The method for collecting the Personal Information is solely through the data that you input through the App.  We rely entirely on you to enter the information requested.  We do not use any other method to collect your Personal Information.  

Avenir uses Plaid Inc. (“Plaid”) to gather your data from financial institutions.  By using the Service, you grant Avenir and Plaid the right, power, and authority to act on your behalf to access and transmit your personal and financial information from your relevant financial institution. You agree to your personal and financial information being transferred, stored, and processed by Plaid in accordance with the Plaid End User Privacy Policy at https://plaid.com/legal/ios/.

When you use the Avenir App, we may also store information based on your usage history.  This could include your purchases, your transaction history and cookies that may identify your account.

If the personal information on file for you changes, or if you no longer desire our service, you may correct or update it by making the change by emailing Avenir at contact@avenirapp.co

 

5.    Our Use of Your Personal Information

We may use information to enforce Avenir’s Acceptable Use Policy.   

In addition, we may, from time to time offer promotions with various businesses, websites or mobile applications or third parties, for which we may use your information. 

We use cookies on the Avenir App.  However, Avenir does not link the information we store in cookies to any Personal Information submitted by you while registering or using the Avenir App. 

 

6.    We care about the security and privacy of your Personal Information

The security of your Personal Information, in electronic format, is important to us and we take reasonable and practicable steps to protect it from misuse, interference, loss, unauthorized access, modification, and unauthorized disclosure by establishing and enforcing technical security measures.

When, and if, there is a need for us to store your Personal Information with a third party data storage provider, we use contractual arrangements to ensure that those providers take appropriate measures to protect the information.  Avenir follows generally accepted standards to protect your Personal Information.  However, no method of storage is 100% secure.  Avenir cannot guarantee absolute security in relation to your Personal Information.  

We will keep a copy of your registration and transaction records for 5 years in adherence with the requirement of Applicable laws and regulations.  Your Personal Information will be destroyed in irretrievable and unusable form in adherence with Avenir’s physical and/or technical information security measures when retention is no longer required.

 

7.    Our need to share your Personal Information

To comply with legal and regulatory mandates and requests from a legal or regulatory authority of appropriate jurisdiction, we may need to submit your Personal Information to government agencies.  Further, we may share your geographical location only with select business partners. 

 

8.    Your way to access or correct your Personal Data

We will process all your requests for access or correction to your Personal Information unless there are practical, contractual and legal reasons that would prevent us from doing so. You have the right to ask for a copy of any Personal Information we hold about you, as well as to ask for it to be corrected if you think it is wrong.

9.    Additional Rights for California Users

If you are a California resident, California law requires us to provide you with some additional information regarding how we collect, use, and share your “personal information” as defined in the California Consumer Privacy Act (“CCPA”), other than the personal information we collect in connection with providing financial products and services.

Depending on how you interact with our website and services, we may collect the following categories of personal information about you, in addition to the information we collect in connection with providing services:

  • Identifiers, such as your name and contact information, IP address, and mobile device identifiers; and
  • Commercial information such as purchase history.

Your California Privacy Rights

If you are a California resident, you may have certain rights.  California law may permit you to request that we:

  • Provide you the categories of personal information we have collected or disclosed about you in the last twelve months; the categories of sources of such information; the business or commercial purpose for collecting or sharing your personal information; and the categories of third parties with whom we shared personal information.
  • Provide access to and/or a copy of certain information we hold about you.
  • Delete certain information we have about you.

Certain information may be exempt from such requests under applicable law. For example, we need certain types of information so that we can provide the Avenir Services to you and for compliance with applicable law. If you ask us to delete certain information, you may no longer be able to access or use the Avenir Services.

California consumers may request, once per year, that we disclose the identity of any third parties with whom we have shared personal information for the third parties’ direct marketing purposes within the previous calendar year, along with the type of personal information disclosed.
